Mesothelioma Education

The Fairness in Asbestos Injury Resolution Act of 2005 (FAIR Act) was intended, in part to provide support for the victims of mesothelioma and their families. Mesothelioma is a tumor, malign or benign which affects the lining of the chest and abdomen caused by exposure to asbestos. Since the 1970’s, more than 700,000 claims have been filed for asbestos-related injuries resulting in litigation and insurance claims costs of over $70 billion. Nearly 80 companies who have paid out this money have become bankrupt.

Some Provisions

Three needs have come out of this situation. Victims of mesothelioma or those exposed to asbestos need compensation for their care. Companies who are no longer in business cannot provide these monies. Existing companies need shielding from lawsuits in order to remain in business. A program to advance the detection, prevention, treatment and cure of the disease by recognizing the types and symptoms of mesothelioma had to be created.

The National Mesothelioma Research and Treatment Program aims to fill some of these needs. It is to be made up of three centers: Mesothelioma disease Research and Treatment Centers, Mesothelioma Registry and Tissue Bank, and Center for Mesothelioma education. The Center for Mesothelioma education receives funding from the director and administrator of the National Institute of Health to maintain the Center. It is intended to promote education and awareness, make information available to patients and their families, and work with the other centers to advance research.

This bill was introduced in April of 2005 but no action has been taken. Mesothelioma news can now be found via online resources and medical journals to keep physicians informed. The importance of mesothelioma education is to make potential victims aware of how exposure to asbestos could occur and how to recognize the symptoms of the disease in as early a stage as possible.

Physicians also need to know what to look for. Very few doctors have had experience diagnosing or treating the disease. They need the latest materials to help them recognize the symptoms and assist their patients in locating effective treatment.
